KidsMustRead.com (‘Website’) is a website owned and operated by Kids Must Read Limited (‘KidsMustRead’, ‘we’ or ‘us’). These Terms of Service (‘Terms’) govern all individuals and entities that may access the Website (‘You’). These Terms also govern the content available through the Website, Your membership and any other use of KidsMustRead.com by You (‘Services’). Your use of our Services signifies that you have read, understood and accepted these Terms, KidsMustRead’s Mission and the Privacy Policy, forming legally binding contracts between you and us (‘Agreements’).

We reserve the right to modify these Agreements in our sole discretion by updating the Agreements available on the Website.

The Mission

KidsMustRead.com aims at providing guidance to parents, guardians, teachers and all care-givers to develop a habit of reading in children. It strives to build the reading confidence of children towards books in all genres, which are in addition to what may be prescribed in schools and curriculums. Reading has several benefits – it strengthens oral and written language skills and helps children become empathetic global citizens.

KidsMustRead.com hopes to reignite the joy of reading and build the reading-for-pleasure confidence in children by guiding care-givers with:

a. Strategies and topics that can be followed to select interest and age-appropriate books.

b. A search engine that finds and suggests a realistic ‘must-read’ children’s book list specific to the search criteria.

c. Information and updates about literature / book related events and fests around them.

1. Your use of the Services, representations and warranties

1.1. You may use the Website if you are above 13 years of age (or the minimum age required as per your country).

1.2. You understand that the Services are not directed towards children, albeit they are for the benefit of children.

1.3. You agree to provide us with accurate and complete information when you register for an account on the Website and to keep your account information up-to-date.

1.4. You agree to be responsible for maintaining confidentiality of your account information and for all activities that may occur under your account information.

1.5. You shall not engage in conduct that is in breach of the Agreements, is unlawful, misleading, discriminatory or in any manner illegal.

1.6. You shall not misuse the Services to your benefit and to the prejudice of others, including us, in any manner, which may constitute an illegal / unlawful act. Specifically, you agree that you shall not pirate or copy the content on the website and/or infringe KidsMustRead’s Intellectual Property, in any manner.

1.7. You shall comply with applicable laws and regulations, at all times, in your use of the Services.

1.8. You agree that you shall make only personal and non-commercial use of the Services.

1.9. You confirm that you are aware of the laws of your country/ the country from which You have accessed the Services and shall not access, use or otherwise utilize any information that is banned/ restricted or relates to information that is banned / restricted in such country, including purchase any book that may be banned/ restricted.

2. Fees

2.1. Our Services are offered on a member-only basis, however, we reserve our rights to charge a fee as will be notified to you as when applicable.

2.2. You may access up to a maximum of three book reviews, complimentary, even prior to registration as a member.

3. Proprietary Rights

3.1. The Services and information/ content contained therein, including without limitation, the trademarks, logos, literary works, images, artistic works, copyrights, and all intellectual property rights related thereto are and remain the exclusive property of Kids Must Read Limited (‘ KidsMustRead Property’).

3.2. Your use of the Services does not create any license in KidsMustRead Property and does not permit you to copy the contents of the Website or make any derivative use of the Service or information contained therein, including the contents of the website.

3.3. You may not use the information / content contained on the Website to mine data or gather data for any benefit to the prejudice of KidsMustRead.

3.4. The Agreements do not transfer any intellectual property in the Services or information contained therein or rights/ title in any KidsMustRead Property to you.

3.5. You may not use any KidsMustRead Property or the Services for any purpose not expressly permitted by the Agreements.

4. Copyright Infringement

4.1. KidsMustRead has the utmost respect for third-party intellectual property rights. If you believe that your copyright has been infringed by any information/ content on the Website, you may notify us in writing via our contact details stated at Contact Us.

4.2. You are called upon to provide us with the following information in your notice:

4.2.1. The description of the work with adequate information to identify the work.

4.2.2. Details establishing that you are the owner or exclusive licensee of copyright in the work

4.2.3. Details establishing that the information available on the Website is infringing.

4.2.4. Details of location on the Website where the information is available; please provide URL.

4.2.5. Your details including name, email address and telephone number.

4.2.6. Undertaking that the above information is accurate, made under the penalty of perjury.

5. Third Party Services

5.1. Some Third-Party Services may be embedded within the Website and that you may interact with in your use of the Services. You understand that these are services developed and enabled by third parties and that KidsMustRead does not have any responsibility for these Third-Party Services.

5.3. Your use of the Third-Party Service allows us to grant the Third-Party with access to some of your data, such as cookies. The use of this data shall be handled by the Third-Party’s policies and practices.

5.5. KidsMustRead assumes no control over the Third-Party or any responsibility for their services.

5.6. You expressly relieve us from any responsibility for the Third-Party Service or any liability arising from Your use of the Third-Party Service.

6. Indemnification

You agree to defend, hold harmless and indemnify KidsMustRead and its directors, employees, agents and officers from and against any claims, liability, losses, damages, costs and expenses arising from your use of the Services, including from any content / information that is posted /uploaded on the Website from your account and from any subsequent action taken by You in relation / consequential to the Services.

7. Disclaimer of Warranties and Limits on Liability

7.1. KidsMustRead hereby disclaims all warranties of any kind, express or implied, to the extent permissible by law. We make no warranty that the Services shall be free from errors or that the Website may not occasionally suffer from interruptions.

7.2. The Services are provided on an AS-IS and AS AVAILABLE basis. KidsMustRead makes no representation or warranties of any kind as to the operation of the Services.

7.3. You expressly agree that your use of the Services is at your sole risk and KidsMustRead shall not be responsible for any damage /illegal action by You arising from the information contained in the Website.

7.4. KidsMustRead hereby disclaims that all information about books made to you through the Website are mere suggestions based on KidsMustRead’s personal opinion. You are advised to exercise discretion when accessing the information made available on the Website. If you find that certain books are unsuitable for any reason, KidsMustRead shall not be liable for the same.

8. General Provisions

8.1. Governing Law and Jurisdiction: This Agreement shall be governed by the laws of Hong Kong. You agree that any action arising from this Agreement shall be submitted to the non-exclusive jurisdiction of the Hong Kong courts.

8.2. Severability: If any provision of this Agreement is prohibited or unenforceable, such part shall not invalidate the remaining portions of the Agreement.

8.3. No Waiver: Non-enforcement of Terms by KidsMustReads does not imply and may not be considered a waiver of our rights.
